Information For Solicitors And Trustee Companies

BaptistCare fully appreciates the special role that members of the legal profession play in facilitating charitable bequests. Thank You.

All donations and bequests of a general nature made to BaptistCare are administered by the BCS Foundation.

The Role of the BCS Foundation

The BCS Foundation was established in June 1995 to celebrate and mark the jubilee of the incorporation of BCS. 

The BCS Foundation accepts donations, bequests and other benefits from the public.  The funds are invested in accordance with the provisions of the Trustee Act of NSW.  The ‘Trustees for BCS Foundation’ is a charitable fund and is endorsed as a Deductible Gift Recipient (DGR) with donations (but not testamentary gifts such as bequests) of $2 and over being tax deductible. 

The Trustees of BCS Foundation comprise three directors of BaptistCare and four independent Trustees.  All bequests to the BCS Foundation are invested and income generated by these investments are provided to BaptistCare Programs as the Trustees of the Foundation determine from time to time.

Suggested Bequest Wording

The following suggested clauses have been prepared to assist you and your client in the preparation or amendment of a Will.

Alternative 1 – A general bequest

Without direction for a bequest to be applied to a specific part of BaptistCare’s activities:

‘I give _____________ ($xx or xx% of my estate/the rest and residue of my estate/other)

to The Trustees for BCS Foundation (ABN 82 889 922 403)

AND I DECLARE that a receipt issued on the authority of the said Trustees shall be sufficient discharge to my Executor in respect of this bequest.’

Alternative 2 – A specific bequest

With direction for a bequest to be applied to a specific part of BaptistCare’s activities:

‘I give _____________ ($xx or xx% of my estate/the rest and residue of my estate/other)

to BaptistCare (ABN 90 000 049 525) to be used for (Description of specific purpose or BaptistCare program)

AND I DECLARE that a receipt issued on the authority of BaptistCare shall be sufficient discharge to my Executor in respect of this bequest.’
